The Transport Regulations were drawn up in accordance with Act No. 56/2012 Coll. on Road Transport, Act No. 8/2009 Coll. on Road Traffic, Act No. 40/1964 Coll. Civil Code.

01. Introductory provisions

The Transport Regulations regulate the transport conditions of the company TAXI LIPTOV in the capacity of a carrier /hereinafter referred to as the "Carrier"/ necessary for the conclusion of a transport contract in a taxi service /hereinafter referred to as the "Transport Regulations"/.

The Transport Regulations enter into force on the date of their publication at the company's registered office. After their publication, their content is part of every contract of transport and regulates the rights and obligations of the participants.

The published Transport Regulations are part of the carrier's proposal for the conclusion of a transport contract and, after its conclusion, their content is part of the contractual rights and obligations of the participants.

02. Definition of basic terms

Taxi service is the operation of passenger transport by taxi vehicles as a means of transporting individual passengers or groups of passengers to a destination according to a passenger transport contract.

The carrier has an operating obligation within the scope of the concession, a transport obligation within the scope of the transport regulations and a tariff obligation according to the tariff.

The carrier may conclude a contract for the carriage of persons with the passenger:

  • by the taxi driver at a taxi stand, or anywhere in the territory specified in the concession where he is with the taxi vehicle while driving without a passenger
  • at its headquarters, at another previously announced location

03. Obligations of the carrier

The carrier is obliged to:

  • Operate passenger road transport (taxi service) according to the transport regulations.
  • Mark each operated vehicle with its business name.
  • Ensure a technical base equipped for the operation, maintenance, technical inspection, parking and garage of vehicles and for the care of vehicle crews, passengers and cargo within the scope of the transport services provided.
  • Ensure that each operated vehicle has a document confirming the granted permit.
  • Ensure the publication and accessibility of the current text of the transport regulations at the company's registered office.
  • Be insured for liability for damage caused by the operation of passenger road transport (taxi service), passengers and third parties.
  • Transport passengers according to the valid taxi service price list and, after the transport, issue the passenger a receipt for the transport performed and the payment of the fare in the vehicle taxi services.
  • To ensure the safety, comfort and smooth transportation of passengers and the transportation of their luggage.
  • If, on the basis of a contract with a carrier, a carrier providing passenger road transport in a taxi service provides the same scope of the provisions of these transport regulations.

04. Taxi vehicle

A taxi vehicle can only be a vehicle that:

  • is specified in the concession and has a taxi vehicle registration number assigned in the concession; this number must be placed in the taxi vehicle in a place visible to the passenger
  • is marked on the front left and right doors with the business name of the taxi operator and the telephone number of the carrier
  • has a permanently installed functional taximeter that meets the requirements for designated meters, which allows the passenger to monitor the immediate price of the fare during the transport and which issues a receipt for the paid fare
  • has a basic fare rate on the right front door and inside the taxi vehicle in a place visible to the passenger
  • is insured in the event of liability for damage caused to the passenger's health or property
  • is equipped with a fixed or removable yellow roof light with the inscription TAXI, which must be lit when the taxi is free. If a taxi car: • performs transportation from the conclusion of the contract with the passenger until the end of the transportation, the roof light is turned off • does not perform taxi service, the roof light must be removed
  • must allow the transportation of at least 50 kg of travel luggage when fully occupied within the total weight of the vehicle or must have a luggage compartment or loading space with a volume of at least 375 dm3
  • has at least three entrance doors to the driver and passenger compartment
  • is approved for the transportation of at least four persons or at most nine persons including the driver according to the registration certificate
  • is no more than eight years old from the date of commissioning
  • is fit for operation according to the technical inspection and emission control

05. Rights and obligations of a taxi driver

Only a person who holds a taxi driver's license may be a taxi driver. A driver's license may be issued to a person who:

  • has held a driving license for a group or subgroup authorizing the driving of a taxi vehicle for at least three years
  • is at least 21 years old
  • is fully capable of legal acts
  • is of good repute

The driver of a taxi vehicle is obliged to provide transport services according to the transport regulations, in particular:

  • transport a passenger according to the instructions of the dispatcher from a pre-arranged location and a passenger who expresses interest in transportation at a taxi stand, at a usual location on a regular route for transporting a group of passengers or anywhere on the road while the taxi vehicle is driving without a passenger, except for regular transport stops
  • use a roof light to indicate whether the taxi vehicle is free or occupied by a passenger or a placed order
  • load and secure the passenger's luggage and other belongings and unload them after the transportation is completed
  • allow the passenger to view the taximeter display during the trip from boarding to disembarking
  • carry out transportation along the shortest transportation route allowed by the traffic situation; another transportation route may be used only with the passenger's consent or at his/her suggestion
  • pick up another passenger only with the passenger's consent or at his/her suggestion; this does not apply if a passenger transport contract has been concluded in advance with the passenger
  • issue the passenger a receipt for the paid fare; a copy in paper form or in electronic form is part of the taxi operator's registry
  • have a driver's license in the taxi vehicle in a place visible to the passenger
  • have complete tariff conditions in the taxi vehicle and allow the passenger to inspect them upon request

The taxi driver may refuse to perform the transport or not complete the transport that has been started if:

  • this is not possible due to the technical condition and permeability of the road or the safety and smoothness of road traffic on the transport route, especially as a result of weather conditions, damage to the road or a traffic accident
  • the passenger's behavior, especially if he is aggressive or armed, or the time of transport, the destination, the transport route or other circumstances raise concerns in the driver about his health, the safety of transport or the taxi vehicle
  • due to the passenger's condition, there is a risk of soiling the taxi vehicle or harassing the driver while driving
  • despite the warning, the passenger smokes, consumes food and drinks or feeds the animal being transported in the taxi vehicle or manipulates hand luggage, newspapers, maps or other items in the front seat that may limit the driver's view or endanger the driving of the taxi vehicle
  • the passenger has luggage that, due to its quantity, size, weight or shape cannot be transported at once, or wants to transport animals that, due to their size, number or behavior, cannot be transported in the passenger compartment or in the luggage compartment

06. Taxi service activity

The carrier has a transport obligation within the scope of the transport regulations:

  • The carrier offers passenger transportation by order service, while the taxi driver ensures its proper and timely service and is obliged to transport the passenger according to the instructions of the dispatching office from a previously agreed place. The destination of the transportation is determined by the transported passengers unless otherwise agreed in advance
  • The taxi driver is also obliged to transport a passenger who expresses interest in transportation at a taxi stand or anywhere on the road while the taxi is driving without a passenger, except for regular transport stops
  • The price for transportation is affected by waiting at intersections at traffic lights, in queues, and kilometers traveled (during detours)

When ordering a taxi vehicle, the customer is obliged to provide:

  • name of the customer or the person being transported
  • boarding point of the person being transported
  • telephone contact of the customer or the person being transported

During transportation, the driver and passengers may not smoke, drink, eat, or handle hand luggage, newspapers, maps, or other objects in the front seat that could limit the taxi driver's view:

  • The passenger's hand luggage can also be transported in the passenger compartment.
  • When ordering transportation, the customer must also notify the taxi service - dispatching office of the transportation of oversized travel luggage, such as crutches, walking sticks, strollers, cages, packages, skis, sleds and other items that could be dangerous for the driver or passenger in the event of a traffic accident or sudden movement of the car. Such items may only be transported in the luggage compartment.
  • Luggage and other items shall be loaded and unloaded, placed or secured exclusively by the taxi driver.
  • In a taxi vehicle, persons may only be transported in the designated places up to the permissible payload of the vehicle, while the number of persons transported may not exceed the number of seats (including the driver) stated in the vehicle registration certificate.
  • Only a passenger may be transported in the front seat next to the driver, who is permitted to be transported by the regulations on road safety and smooth traffic; each person transported in a taxi vehicle during transport is obliged to use the seat belt equipped with the vehicle.

After the transport has been completed, the taxi driver is obliged to issue the passenger with a receipt, which contains in particular:

  • document number
  • vehicle registration number
  • trip date
  • trade name of the carrier, address of operation or registered office
  • departure and destination of the transport
  • fare paid
  • signature of the taxi driver who carried out the transport

07. Passenger transport contract, origin, content

The contractual relationship between the carrier and the passenger arises on the basis of a concluded contract for the carriage of persons pursuant to Sections 760 to 764 of the Civil Code (hereinafter referred to as the "carriage contract"). The customer may also conclude a contract for the carriage of persons with the passenger in the following manner:

  • through the taxi driver at the taxi stand, or anywhere in the territory specified in the concession, where the taxi vehicle is located during the journey without a passenger
  • at its registered office
  • through the dispatching office, while the transport contract is concluded by an oral order of the passenger, who undoubtedly indicates that he wants to conclude a transport contract for the purpose of transport to a specified place, thereby also agreeing to the carrier's price for the transport of the passenger. Before carrying out the transport and concluding the transport contract, the passenger has the right to familiarize himself with the valid taxi price list. After the transport has been carried out, the taxi driver is obliged to issue a receipt to the passenger upon request. By concluding a transport contract, the carrier is obliged to transport the passenger properly and on time to the destination in accordance with the contractual terms and conditions and the terms of the transport regulations. The taxi driver may refuse to conclude a transport contract and perform the transport under the conditions of Art. 5 of the Transport Regulations. By carrying out the transport on the basis of the concluded transport contract and under the conditions of the Transport Regulations, the passenger is obliged to pay the specified fare according to the taxi price list. Refusal to pay the fare is resolved by calling the Police and is enforceable in court. The passenger is obliged to pay the carrier the interest on late payment specified by law

08. Termination of the contract of carriage

The carrier may withdraw from the concluded transport contract if the customer does not comply with the terms of the transport contract or the provisions of the transport regulations.

The driver of a taxi vehicle may withdraw from a concluded transport contract if:

  • the passenger smokes, consumes food and drinks or feeds the animal being transported in the taxi vehicle despite the driver's warning
  • handles hand luggage, newspapers, maps or other items in the front seat that may limit the driver's view or endanger the driving of the taxi vehicle
  • endangers his safety, pollutes the interior of the vehicle, changes the route and destination of the transport without reason
  • raises concerns about the safety, health and life of the driver or fellow passengers. The passenger may withdraw from the concluded transport contract if the carrier or the taxi driver has violated the contractual terms or the terms of the transport regulations

09. Refusal of transportation and handling of found items

The driver of a taxi vehicle prepared for transportation may refuse to perform transportation if:

  • čas prepravy, cieľové miesto, trasa prepravy alebo iné okolnosti vzbudzujú u vodiča obavu o svoje zdravie, bezpečnosť prepravy alebo o vozidlo taxislužby
  • vodičovi to neumožňuje technicky stav a priepustnosť cesty alebo bezpečnosť a plynulosť cestnej premávky na trase prepravy, najmä v dôsledku poveternostných vplyvov, poškodenia pozemnej komunikácie alebo dopravnej nehody
  • cestujúci je zjavne pod vplyvom alkoholu alebo inej návykovej latky, hrozí znečistenie alebo poškodenie vozidla taxislužby, alebo obťažovanie vodiča počas prepravy
  • to neumožňuje správanie sa cestujúceho, najmä ak je agresívny alebo je ozbrojený, alebo inak vzbudzuje u vodiča obavu o svoje zdravie, o bezpečnosť prepravy a o vozidlo taxislužby
  • cestujúci ma batožinu, ktorú vzhľadom na jej početnosť, veľkosť, hmotnosť alebo tvar nie je možne naraz prepraviť, alebo ktorá by mohla poškodiť alebo znečistiť vozidlo taxislužby
  • cestujúci ak má záujem prepravovať zvieratá, ktoré vzhľadom na ich veľkosť, početnosť alebo správanie nie je možne prepraviť v priestore pre cestujúcich ani v batožinovom priestore

If a taxi driver finds a passenger's lost item in a taxi vehicle, he is obliged to return it to the owner. If the owner of the item is unknown or if he does not report on the day of the find, the taxi driver is obliged to hand over the item to the taxi dispatch center or the police.

If the person who lost or forgot the item in the taxi reports it, and there is no doubt about the credibility of their claim, the item is subsequently returned to them.

The finder has the right to reimbursement of necessary expenses.

10. Responsibility

The carrier shall be liable for the breach of the taxi service's obligation to transport the passenger properly and on time in accordance with the transport regulations pursuant to Section 763, Paragraph 2 of the Civil Code. In the event that there is an unjustified delay or failure to carry out the transport due to the fault of the carrier or taxi driver, the carrier shall be obliged to compensate the passenger for the damage caused by the failure to carry out the transport on time, as follows:

  • Compensation for delay will be resolved by a proportional discount on the paid fare
  • Compensation for failure to carry out the transport will be resolved by payment of the fare according to the taxi service price list. The carrier shall be relieved of its liability if it proves that it could not have prevented the damage even if it had exerted all the efforts that could be required of it

11. Claims, complaints, compensation for damage

  • The passenger or the person entitled to file a complaint regarding the transport or in connection with the transport, without undue delay, no later than 30 days from the performance of the transport. The passenger has the right to be informed by telephone or in writing about the progress of the complaint.
  • The passenger is entitled to file a complaint regarding dissatisfaction with the transport in the following ways:
    • By sending a complaint to the carrier's email address.
    • By sending a written complaint to the carrier's registered office address.
  • In the complaint, the person entitled must define his/her requirements and briefly justify them. He/she must also attach documents certifying the legitimacy of his/her claim as well as documents proving the performance of the transport (payment of the transport fee).
  • If the complaint does not contain all the necessary elements, the carrier will immediately invite the complainant to complete it within the specified period. If the complaint is not completed and sent within the specified period of no less than 8 days, it is considered not filed.
  • If the passenger, or the person who is authorized to file a complaint from or in connection with the transport, must file it with the carrier in writing, without undue delay, no later than 7 calendar days from the fact to which the complaint relates.
  • If the passenger suffers damage to his health or to the luggage transported with him or to the things he had with him during the transport, the carrier is liable for it according to the provisions of Act No. 40/1964 Coll. Civil Code on liability for damage caused by the operation of a means of transport (Sections 427 to 431).
  • If it concerns the right to compensation for damage to health or to the luggage transported with passengers or to the things he had with him; this right may be exercised through the courts
  • If the entitled party claims damage caused to health and property, or damage caused by theft or loss of property, he shall proceed in accordance with Section 106 of the Civil Code.
  • The passenger is obliged to exercise the right to compensation for damage to the passenger's luggage transported together with him or to the property that the passenger had with him in writing first with the carrier, no later than 30 days from the date on which the damage occurred, or within 15 days from the date on which the injured party learns about the damage and who is responsible for it.
  • Complaints and claims regarding the fulfillment of obligations under the transport regulations and their handling by the carrier pursuant to this article may be examined by the Slovak Trade Inspection.

12. Emergency

An extraordinary event (hereinafter referred to as an "Extraordinary Event") in the performance of passenger transport - taxi services is considered to be:

  • a traffic accident involving a taxi vehicle or if the driver witnesses a traffic accident
  • a vehicle fire
  • an accident or sudden illness of a passenger or other person

In the event of an emergency, the taxi driver is primarily obliged to:

  • immediately stop the vehicle
  • take the necessary measures to save passengers and property threatened by the emergency
  • provide the injured person with the necessary first aid according to their abilities and possibilities and immediately call for professional medical assistance
  • take appropriate measures to ensure that road traffic safety is not endangered and to enable its restoration
  • inform the carrier of this fact

If an emergency results in injury or death to a person, damage to a road or a facility of general utility, or if material damage exceeding ten times the employee's minimum monthly wage occurs, the taxi driver is obliged to:

  • report the emergency to the police immediately
  • refrain from any action that would be detrimental to the investigation of the emergency
  • remain at the scene until the police arrive, or return to the scene immediately after calling for help or after reporting the emergency
  • inform the carrier of this fact

13. Final provisions

These transport regulations are part of the contract of carriage, while the carrier and the passenger have the right to regulate rights and obligations differently from those regulated in the transport regulations in a written agreement. By concluding the transport contract, the passenger declares that the carrier has informed him of the rights and obligations arising from the contract of carriage, as well as the rights and obligations arising from the transport regulations.

The carrier reserves the right to change or cancel the transport schedule, and immediately informs passengers about the changes by means of a notice at the carrier's points of sale, indicating the date on which these changes come into effect. The transport schedule comes into effect no earlier than 15 days after the date of publication of the notice of its issuance. If the passenger does not agree with the change in the transport schedule, he is obliged to notify his disagreement in writing no later than 30 days from the date of validity of the new transport schedule.

Unless the carrier and the passenger agree otherwise, they have the right to terminate their mutual contractual relations and settle their mutual claims. If the passenger does not notify the carrier of his disagreement with the change in the transport schedule within the above-mentioned period, it is considered that he agrees with the change and accepts the carrier's offer and the passenger is subject to the changed transport schedule from the date of the change. The validity of these transport schedules or part thereof may only be excluded by written agreement between the passenger and the carrier.
